Student Statement of Rights      

 

 Vancouver Island College is certified with the Private Training Institutions Branch (PTIB) of the British Columbia Ministry of Advanced Education and Skills Training.


Before you enrol at a certified private training institution, you should be aware of your rights and responsibilities.


You have the right to be treated fairly and respectfully by the institution.

 

You have the right to a student enrolment contract that includes the following information:

§  amount of tuition and any additional fee for your program

§  refund policy

§  if your program includes a work experience, the requirements to participate in the work experience and the geographic area where it will be provided

§  whether the program was approved by PTIB or does not require approval.

 

Make sure you read the contract before signing.  The institution must provide you with a signed copy.   

You have the right to access the institution’s dispute resolution process and to be protected against retaliation for making a complaint.

 

You have the right to make a claim to PTIB for a tuition refund if:

 

§  your institution ceased to hold a certificate before you completed an approved program

§  you were misled about a significant aspect of your approved program.


You must file the claim within one year of completing, being dismissed or withdrawing from your program.

Attendance Policy

1. To ensure the success of completing the IELTS program, daily attendance is expected at Vancouver Island College. Students must keep good attendance and attend at least 75% of their classes.

2. Students who do not meet the minimum attendance requirements listed above without a valid reason will be dismissed.

3. Students must contact the Director Assistant as soon as possible to report an absence.

Dismissal Policy

Students are expected to meet and adhere to the Code of Conduct set out in this policy while completing the IELTS preparation program at Vancouver Island College.

Code of Conduct

While on Vancouver Island College premises or in the course of activities or events hosted by Vancouver Island College, students:

(a)must comply with all applicable Vancouver Island College policies, including the Attendance Policy and Respectful and Fair Treatment of Students Policy;

(b)must treat all students and staff with respect and must not engage in physically aggressive, threatening, harassing, discriminatory or otherwise offensive behaviour;

(c)must not steal, misuse, destroy or deface Vancouver Island College property;

Students who violate the Code of Conduct will be subject to the procedures and may include dismissal from the institution.

Procedure:

(1) All concerns relating to student misconduct shall be directed to the Director Assistant. Concerns may be brought by staff, students or the public.

(2) The Director Assistant will arrange to meet with the student to discuss the concern(s) within 5 business days of receiving the complaint. If the alleged conduct is of such a serious nature that an immediate dismissal may be warranted, the Director Assistant will meet with the student as soon as is reasonably possible.

(3)  Following the meeting with the student, the Director Assistant will conduct whatever further enquiry or investigation is necessary to determine whether the concerns are substantiated.

(4) Any necessary inquiries or investigations shall be completed within 7 business days of the initial meeting with the student.

(5) The Director Assistant will meet with the student and do one of the following:

 (a)  Determine that the concern(s) were unsubstantiated;

(b)  Determine that the concern(s) were substantiated, in whole or in part, and either:

(i)   Give the student a warning setting out the consequences of further misconduct;

(ii)   Set a probationary period with appropriate conditions; or

(iii)  Recommend that the student be dismissed from Vancouver Island College.

(6) The Director Assistant will prepare a written summary of the determination. A copy shall be given to the student, and the original will be placed in the student file.

(7)  If the student is issued a warning or placed on probation, the Director and the student will both sign the written warning or probationary conditions and the student will be given a copy. The original document will be placed in the student’s file.

(8) If the recommendation is to dismiss the student, the Director will review the recommendation and accept or reject it. If the recommendation is accepted by the Director, the Director will meet with the student to discuss him/her from study at the institution. The Director will deliver to the student a letter of dismissal and a calculation of refund due or tuition owing. If the recommendation is rejected by the director, the director will follow steps 5 through 7, above.

(9) If a refund is due to the student, Vancouver Island College will ensure that a refund is forwarded to the student within 30 days of the dismissal.

(10) If the student owes tuition or other fees to the institution, Vancouver Island College may undertake the collection of the amount owing.

 

Dispute Resolution Policy



1. This policy governs complaints from students respecting Vancouver Island College and any aspect of its operations. A student who makes or is otherwise involved in a complaint will not be subject to any form of retaliation at any time.

2. All student complaints must be made in writing.

 3.  The student must provide the written complaint to the Director Assistant who is responsible for making determinations in respect of complaints. If the Director Assistant is absent or is named in a complaint, the student must provide the complaint to the Director.

 4. The process by which the student complaint will be handled is as follows:

1) The student should provide the complaints to the Director Assistant: Yun Liao (Email Address: rockwayeducation@gmail.com). The Director Assistant will render a final decision. Written reasons for the determination will be provided to the student within 30 days after the date on which the complaint was made.

2)If the Director Assistant is absent or is named in a complaint, the student must provide the complaint to the Director: Yi Pang(Email Address: vancouverislandcollege@gmail.com). The Director will render a final decision. Written reasons for the determination will be provided to the student within 30 days after the date on which the complaint was made.

 5. The process will not impose a fee in relation to the complaint.

 6.  A student dissatisfied with the institution’s final decision may file a claim with the Private Training Institutions Branch (PTIB)

(www.privatetraininginstitutions.gov.bc.ca) on the grounds that the institution misled the student regarding a significant aspect of the program. 

7. A student must file the claim within one year of completing, being dismissed or withdrawing from the program.


8. A student making a complaint may be represented by an agent or a lawyer.


 

Grade Appeal Policy

A student may appeal the final grade for IELTS Preparation Course at Vancouver Island College if there are grounds to believe that:

§  Evaluation criteria for the course were changed from those articulated;

§  Evaluation standards are unreasonable or different from those applied to other students; or,

§  Evaluation was determined on some basis other than performance.

 

The process by which a student may appeal a grade is as follows:

1. Informal Process

§  Before launching a formal appeal, a student should make every effort to resolve the issue informally with the instructor(s) involved.

§  The student must request that the instructor review the assigned grade with the student before a formal appeal is launched. This request must be received by the instructor, in writing, within seven business days of the student's grade being posted. The instructor must discuss the matter with the student and confirm his/her decision to the student, in writing, within 5 business days subsequent to receiving the request for an informal review.

2. Formal Process

§  Following an informal process, a student may request a formal review if the student is still disagreed with the final grade.

§  The request must be received by the Director of Vancouver Island College, in writing, within five business days of the student's receipt of the instructor's written decision.

§  The Director will discuss the issue with the student and the instructor in an attempt to reach resolution. The decision of the director will be given in writing to the student in 7 business days.

 

Respectful and Fair Treatment of Students Policy

Vancouver Island College is committed to ensuring that its learning environment promotes the respectful and fair treatment of all students.

1. While on Vancouver Island College premises or in the course of activities or events hosted by Vancouver Island College, the following activities are prohibited:

(a)bullying, physically aggressive, threatening, harassing, discrimination, abusive or otherwise offensive behaviour;

(b)consume, possess or distribute alcohol or controlled or restricted substances in class;

(c)solicit or assist another person to commit any act which would subject a student to expulsion, suspension;

(d)contravene any provision of the Canadian Criminal Code or any other federal, provincial, or municipal statute or regulation.

2.If under any circumstances, a prohibited activity occurs, the following outlines the process for addressing the activity,

(a) All concerns relating to student misconduct will be directed to the Director Assistant.

(b) The Director Assistant will arrange to meet with the student to discuss the concern(s) within 7 business days of receiving the complaint. Following the meeting with the student, the Director Assistant will issue a report to the Director and recommend either a warning or a dismissal in 5 business days.

(c) The Director will make the final decision in writing within 7 business days.

 

Payment Method Policy

To provide a secured system against money-laundering, Vancouver Island College accepts the following payment methods to any fees including tuition fee, registration fee, material fee etc.

1.Cash

Vancouver Island College accepts less than CAD800 for each semester from a single student and less than CAD1000 for each school year from a single student.

2. Cheque

Tuition Refund Policy



REFUND POLICY

Circumstances when Refund Payable  

Amount of Refund

Before program start date, institution receives a notice of withdrawal (applies to all students)

·        No later than seven days after student signed the enrolment contract, and

·        Before the program start date. 

100% tuition and all related fees, other than application fee. Related fees include: fees charged for course materials.

·        At least 30 days before the later of:

a)      The program start date in the most recent Letter of Acceptance (international students)

b)     The program start date in the enrolment contract.

Institution will retain 10% of tuition.

Institution must refund fees paid for course materials if not provided to the student.

·        More than seven days after the student and institution signed the enrolment contract, and

·        Less than 30 days before the later of:

a)      The program start date in the most recent Letter of Acceptance (international students)

b)     The program start date in the enrolment contract.

Institution will retain up to 20% of tuition.

Institution must refund fees paid for course materials if not provided to the student.

After program start date, institution provides a notice of dismissal or receives a notice of withdrawal (applies to all students, except those enrolled in a program delivered solely by distance education)

·        After the program start date, and up to and including 10% of instruction hours have been provided.

Institution will retain 30% of tuition.

Institution must refund fees paid for course materials if not provided to the student.

·        After the program start date, and after more than 10%, but before 30% of instruction hours, have been provided.

Institution will retain 50% of tuition.

Institution must refund fees paid for course materials if not provided to the student.

Student does not attend program – “no-show” (applies to all students except those enrolled in a program delivered solely by distance education):

·        Student does not attend the first 30% of the program. 

Institution will retain 50% of the tuition.

Institution must refund fees paid for course materials if not provided to the student.


Institution receives a refusal of study permit (applies to international students requiring a study permit):

·        Before 30% of instruction hours would have been provided, had the student started the program on the later of the following:

a)      The program start date in the most recent Letter of Acceptance

b)     The program start date in the enrolment contract

·        Student has not requested additional Letter(s) of Acceptance.

100% tuition and all related fees, other than application fee.

Student enrolled in a program without having met the admission requirements for the program

·        If the student did not misrepresent the student’s knowledge or skills when applying for admission and the registrar orders the institution to refund tuition and fees.

100% tuition and all related fees, including application fees

 

 

Institution must pay the tuition or fee refund within 30 days after receiving notice of withdrawal or refusal of study permit; providing a notice of dismissal, or the date on which the first 30% of the hours of instruction are provided (no-show).

 

PRIVATE TRAINING INSTITUTIONS BRANCH
